Pikolinos Intercontinental S.A. se réserve le droit de reporter, d’annuler, de modifier le règlement, de répéter ou de mettre fin au concours à tout moment en cas de circonstances exceptionnelles, en communiquant ces circonstances de manière à éviter tout préjudice aux participants au concours.
1º.- PORTÉE ET DURÉE
Le concours se déroulera sur les pages Facebook et Instagram de PIKOLINOS, la boutique en ligne (www.pikolinos.com) et les boutiques physiques Pikolinos. Il se déroulera à l’échelle internationale en Espagne, en France et en Allemagne entre le 19 août et le 1er septembre 2024.
Cette période peut être prolongée ou réduite par Pikolinos si elle le juge opportun, en communiquant cette décision sur la page et le règlement correspondants.
Le présent règlement établit les exigences et les règles de participation qui doivent être acceptées par tous ceux qui souhaitent participer au concours (ci-après, « les participants » ou, individuellement, « le participant »).
La participation effective des participants au concours par les moyens établis dans les présentes, impliquera sans équivoque et sans exception, l’acceptation de toutes les exigences et règles stipulées dans les présentes.
2º.- PARTICIPANTS
Toutes les personnes majeures qui remplissent toutes les conditions énoncées dans le présent règlement peuvent participer gratuitement au concours.
Les employés et collaborateurs de la société organisatrice, ou de l’une des sociétés du groupe d’entreprises auquel elle appartient, ou, en général, les membres de leur famille, ascendants, descendants, conjoints et/ou concubins respectifs, ne peuvent pas bénéficier de cette promotion.

Concernant la politique de protection des données, veuillez-vous référer au point 10 du présent règlement.
Dans le cas où Pikolinos détecte des abus, des actes frauduleux ou des actes préjudiciables aux autres participants de la part d’un ou plusieurs participants, elle peut annuler la participation desdites personnes fautives. Dans le cas où Pikolinos, ainsi que toute autre entité qui lui est liée, détecte une anomalie ou soupçonne qu’un participant entrave le déroulement normal du concours en modifiant ses registres au moyen de tout procédé technique ou informatique ou en réalisant des actes frauduleux qui contreviennent à la transparence de la promotion, elle procédera à la radiation dudit participant, ainsi qu’à l’engagement des poursuites judiciaires appropriées.
5º.- CHOIX DU GAGNANT
10 gagnants seront désignés parmi toutes les inscriptions reçues, complétées et correctes avant la date de fin de chaque tirage au sort, via un tirage au sort sur la plateforme AppSorteos.
Le gagnant recevra deux codes (un pour le sac et un autre pour les chaussures) à utiliser sur www.pikolinos.com. Le gagnant doit passer deux commandes distinctes, une pour chaque article.
6º.- MÉCANISME DU CONCOURS ET NOTIFICATION DU PRIX
Les noms des gagnants seront publiés sur le blog officiel de Pikolinos.
PIKOLINOS INTERCONTINENTAL S.A. se réserve le droit de remplacer le gagnant par un autre participant en cas de substitution, de non-acceptation ou d’impossibilité de contacter le gagnant. Dans ce cas, le ou la gagnant(e) perdra ses droits sur le prix, le prix étant attribué au second gagnant et si le second gagnant ne peut être contacté dans les trente (30) jours civils suivant l’élection du gagnant ou si les circonstances énumérées ci-dessus se produisent, le prix sera déclaré nul.
La renonciation au prix ne donne droit à aucune indemnité ou compensation de quelque nature que ce soit, ni à aucun échange d’argent, sauf dans les cas où cela est décidé par PIKOLINOS. Les gagnants du concours pourront bénéficier du prix suivant :
• Le prix est un code à échanger contre une paire de chaussures et un autre code à échanger contre un sac (les codes seront échangés séparément sur deux commandes différentes sur notre boutique en ligne www.pikolinos.com). Le gagnant dispose de deux semaines à compter de l’annonce du prix pour utiliser les bons.
Si, pour une raison indépendante de la volonté de Pikolinos, le prix n’est pas disponible, Pikolinos se réserve le droit de le remplacer par un autre, de valeur équivalente.
Pikolinos est exempt de toute responsabilité en ce qui concerne les incidents qui peuvent survenir pendant le déroulement du prix et qui sont indépendants de sa volonté.
Le gagnant de ce concours ne peut pas échanger le prix gagné contre un autre prix ni contre un montant équivalent à celui-ci.
Les codes reçus par le gagnant sont personnels et incessibles.

8º.- PUBLICITÉ RELATIVE AU PRIX
L’acceptation expresse du prix par chaque gagnant(e) implique que :
Vous autorisez Pikolinos Intercontinental S.A. (ou tout tiers autorisé par elle) à utiliser votre nom, l’image et/ou les commentaires des participants, en cas de gain du prix, à des fins de marketing, de promotion et de publicité du concours sur tout support et partout dans le monde, sans aucune forme de rémunération pour ce faire.

La participation à ce concours implique, par elle-même, l’acceptation de ce règlement, ainsi que des décisions interprétatives prises par la société.
De même, la participation à ce concours implique l’acceptation des règles d’Instagram, et l’exonération du réseau social de toute responsabilité. Ce concours n’est pas parrainé, approuvé ou administré par le réseau social susmentionné.
12º.- LOI APPLICABLE ET JURIDICTION
Les présentes bases juridiques seront interprétées et régies conformément à la législation espagnole.
Pour toute question litigieuse découlant de l’existence, de l’accès, de l’utilisation ou du contenu des bases juridiques, le client et Pikolinos se soumettront tous deux :
Aux cours et tribunaux de la ville d’Elche, ou s’il n’existe pas de tribunaux de commerce dans cette ville, les tribunaux d’Alicante seront compétents lorsque l’utilisateur est un entrepreneur.

10º.- EXCLUSIONS
Any person who doesn´t fully and adequately meet the participation requirements described in these Terms and Conditions cannot win.
Workers and employees and collaborators of the Pikolinos Group are excluded from the prize.
11º.- ACCEPTANCE OF THE PRESENT BASES
Participation in this contest implies, by itself, the acceptance of these rules, as well as the interpretative decisions that society makes of them.
12º.- APPLICABLE LAW AND JURISDICTION
These legal bases will be interpreted and governed in accordance with Spanish legislation.
For any litigious issue arising from the existence, access, use or content of the Legal Bases, both the client and Pikolinos, will submit:
To the courts and tribunals of the city of Elche, or if there are no commercial courts of that city, those of Alicante will be competent when the user is an entrepreneur.
To the courts and tribunals of the city of the user’s domicile, in the case of a consumer in accordance with current legislation.
