LEGAL BASES DRAW

Pikolinos, whose corporate name is Pikostore S.L with NIF B53906590 and with registered office at Galileo Galilei, 2, 03203-Elche (Spain). Telephone 965681234, email: info@pikolinos.com, carries out a commercial promotion to promote the activities of the company and that will be developed under the following conditions.

Pikostore S.L.U. reserves the right to postpone, cancel, modify the rules, repeat or terminate the contest at any time if exceptional circumstances concur, communicating those circumstances to avoid any harm to the participants in the contest.

1º- SCOPE AND DURATION

The Contest will take place through e-mail and will be international.

The period during which the participation in the Contest will be open from 00:00 am on 12^th September 2022 until 23.00 pm on 18th September 2022, peninsular Spain time (both included). This period may be extended or reduced by Pikolinos if it deems appropriate, communicating such decision on the corresponding page and bases.

The present Bases establish the requirements and the rules of participation that must be accepted by all those people who want to participate in the Contest (hereinafter, the Participants or, individually, The Participant). The effective participation of the Participants in the Contest by the means set forth herein, will unequivocally and without exception imply that there has been an acceptance of all the requirements and regulations stipulated herein.

2º-  PARTICIPANTS

All persons of legal age who meet all the requirements established in these rules can participate for free in the contest.

The workers and collaborators of the convening company, nor of any of the companies of the business group to which it belongs, nor, in general, their respective relatives, ascendants, descendants, spouses and/or common-law partners, may not be winners of this promotion.

3º- COMMUNICATION AND PUBLICATION OF THE PROMOTION

This contest will be communicated through the following means:

4º- MECHANICS OF THE CONTEST AND PARTICIPATION

To participate you must:

1. Be subscribed to the Pikolinos newsletter or subscribe at the time of making the purchase.
2. Make a purchase of an item from the 2022 winter season collection (excluding shoe care products) on on 12^th September 2022 until 23.00 pm on 18th September 2022 (both included), at any Pikolinos store and/or pikolinos.com.

In relation to the Data Protection Policy, please consult Point 10 of these rules.

In the even that Pikolinos detects misuse, fraudulent or harmful acts for the remaining participants by one or more participants, you can cancel the participation of such infringing persons. In the event that Pikolinos, as well as any other entity linked to it, detects any anomaly or suspects that a participant is preventing the normal development of the Contest by altering their records through any technical or computer procedure or carrying out any fraudulent acts that contravene the Transparency of the promotion will proceed to cancel said participant as well as take appropriate legal action.

5º.- WINNER’S CHOICE

One winner will be designated among all entries received, complete, and correct before the end date through a random draw on the Sortea2.com platform. The winner will receive a pair of Pikolinos shoes and a bag of their choice as a prize.

6º.- MECHANICS OF THE CONTEST AND NOTIFICATION OF THE PRIZE

The name of the winner will be published every day on the brand’s Instagram account stories, newsletter and on the blog (https://blog.pikolinos.com/). The Promoter will communicate with the winner by email within the week following the end date of the Promotion. The Promoter will send an e-mail to the winner from the email address: info@pikolinos.com.

The winner must confirm the receipt of the email within 72 hours after sending it. Pikostore S.L.U. reserves the capacity to replace the winner with another contestant, in case of substitution, non-acceptance or the inability to contact the winner. In that case, the grantee will lose the rights to the prize, the prize being awarded to the second winner and if this second winner could not be contacted within thirty (30) calendar days from the election of the winner or the circumstances listed above occur, the prize will be declared void.

The waiver of the prize will not grant the waiver the right to any indemnity or compensation, or exchange for money, except in those cases in which PIKOLINOS so decides. If for reasons beyond PIKOLINOS it is impossible to award the established prize (whether in whole or in part), PIKOLINOS reserves the right to substitute an equivalent prize. The designation of the winners will not be appealable and no claims will be accepted nor will PIKOLINOS enter into any type of communication or correspondence in this regard.

7º- PRIZE

The winner of the contest, will opt for the following prize:

• The award consists of a pair of Pikolinos shoes and a bag of the winner’s choice.
• The winner will receive a code to redeem the prize at the official Pikolinos website or shops. This code is applicable for a single order including one pair of shoes and one bag in a single act and through a single purchase.

• Items cannot be returned or exchanged in cash.

• The code will be valid until 31 December 2022.

If, for any reason outside Pikolinos, there is no availability of the planned prize, Pikolinos reserves the right to substitute them for others, of equal cost.

• Pikolinos shall not be held liable about incidents beyond its control, which may occur during the award.
• The winner of this contest may not exchange the prize won for a different one or for the amount equivalent to it.

Pikolinos will not be responsible for the following extremes:

• For the services that third companies must provide for the award of this promotion.
• In case of failure or any other incident in telecommunications systems, which prevent access to the promotion website with normality.
• For damages of any nature that may be due to the temporary lack of availability or continuity of the operation of telecommunications networks.

The prize is not exchangeable for money or any other object in kind.

8.- PRIZE PUBLICATION

The express acceptance of the prize by the winner implies:

1. That you authorize Pikolinos (or any third party authorized by it) to use his name, the image and / or comments made by the Participants, in the event of winning the prize, for marketing, promotion and advertising purposes of the Contest in any means and anywhere in the world, without any remuneration for it.
2. That your name is published in the official communication channels of Pikolinos.

In accordance with current regulations regarding data protection, the Purpose for the treatment is:

1. Participation in contests, promotions and draw organized by PIKOLINOS. The legal basis for the treatment of your data is the consent for the interested party and/or his legal representative and the data will be kept until the end of the draw, as well as for the time necessary to comply with the legal obligations that may be applicable.
2. Sending commercial communications through the Newsletter. The legal basis for the treatment of your data for this purpose is the consent of the interested party and/or his legal representative and the data will be kept until its deletion is requested by the interested party and/or his legal representative.

Data recipients: No data transfers will be made except in the case that you have given us your authorization for the transfer of the image, to social networks, media and the general public and only for the purpose of promoting and giving to know the draw made by PIKOLINOS.

International data transfers: No international data transfers will be made.

Rights of the interested party:

In both cases, you must accompany the relevant documentation.

10º.- EXCLUSIONS

Any person who doesn´t fully and adequately meet the participation requirements described in these Terms and Conditions cannot win.

Workers and employees and collaborators of the Pikolinos Group are excluded from the prize.

11º.- ACCEPTANCE OF THE PRESENT BASES

Participation in this contest implies, by itself, the acceptance of these rules, as well as the interpretative decisions that society makes of them.

12º.- APPLICABLE LAW AND JURISDICTION

These legal bases will be interpreted and governed in accordance with Spanish legislation.

For any litigious issue arising from the existence, access, use or content of the Legal Bases, both the client and Pikolinos, will submit:

• To the courts and tribunals of the city of Elche, or if there are no commercial courts of that city, those of Alicante will be competent when the user is an entrepreneur.
• To the courts and tribunals of the city of the user’s domicile, in the case of a consumer in accordance with current legislation.
